If you are legally prohibited from owning a firearm and you are found in possession of one (or an unregistered or unlicensed firearm), you will be charged under NY PL § 265.01-b(1), Criminal Possession of a Firearm. In the last few years, this offense has been revised as a felony offense, not a misdemeanor. The weapon needs to be operable (but not loaded) for the offense to be charged.

Criminal Use of a Firearm
If you have used a weapon while committing a Class C violent felony, you can be charged with Second-Degree Criminal Use of a Firearm. Similarly, you can be charged with First-Degree Criminal Use of a Firearm if it is believed you were in possession of/used a firearm while committing a Class B violent felony.
